ANC 3B

Thursday, November 9, 2000

A regular, monthly, public meeting of ANC3B was called to order at 7:40 p.m. on Thursday, November 9, 2000 at Guy Mason Recreation Center.

Commissioners present and constituting a quorum were:  Ann Lloyd Breeden (03), Acting Chair; Richard M. Procida (01); and Toni A. Ritzenberg (04).  Commissioners absent were: Monica Mizerek (O2) and James C. Lively (05).

Housekeeping

Approval of Minutes

The minuets of the October 12 meeting of ANC3B were approved as printed and distributed. (3-0-0)

Quarterly Financial Report

The quarterly report of ANC3B to the DC Auditor, covering July, August, and September of 2000, was approved as printed and distributed. (3-0-0)

October Expense Report

The expense report for October 2000 was approved as printed and distributed. (3-0-0)

Election of Officer

Given Commissioner Procida's imminent move from his Single Member District and the subsequent need to elect a Commissioner to succeed him as Treasurer upon his resignation, Commissioner Breeden nominated Commissioner Ritzenberg to serve as Treasurer, effective November 21, 2000.  Commissioner Ritzenberg accepted the nomination with the following stipulations: 1) that the ANC seek confirmation that she may hold both the Secretary and Treasurer positions simultaneously, and 2) that her term as Treasurer would terminate with the election of new officers at the January meeting.  With those conditions accepted by the reset of the Commission, the nomination was seconded and approved unanimously. (3-0-0)

Old Business

42nd Street Parking

Lynn Reichhardt, a resident of the 4114 Davis Place condominium, reported on the installation of the RPP signs along 42nd Street between Beecher Street and Davis Place, as well as in the 4100 block of Davis Place.  She noted a few outstanding issues, such as the need for additional signs along 42nd Street to ensure proper notice to parkers; the loss of several parking spaces in the Davis to Edmunds block of 42nd Street, as a result of a No Parking zone established by DPW's parking services; and the expectation that residents would soon receive official notice from DPW confirming that enforcement would begin in the RPP zone by mid-December, allowing residents adequate time to secure their RPP stickers.  Commissioner Breeden reported on her conversations with residents and Larry Brown of Parking Services about the issues Ms. Reichhardt raised, noting that the addition of any signs on the Davis Place block would likely result in the loss of spaces (since they would be placed near alleys), that the signs for the 2500 bock of 41st Street were forthcoming, and that the ANC would shortly measure the distance from the intersection of Davis Place and 42nd Street to the "No Parking" sign, to see by how many feet it exceeded the mandatory distance, conjecturing that the no parking zone was at least 70 feet in length.

 

Ms. Reichhardt also raised a question about whether the city intended to install curbs along the park-side of 42nd Street.  Commissioner Breeden reported that she had heard no suggestion that the area be curbed at the edge of the pavement to block the parking, but that the Ward 3 Planning Office representative had mentioned that the city could pave the now-dirt parking area and install curbs where the dirt parking area abuts the woods.  Commissioner Breeden noted her expectation that residents would be part of that decision process, but also pointed out that since DPW is some two years behind on its urgent paving projects, any supplemental work would likely not be undertaken any time soon.

Ms. Reichhardt asked the ANC if it could identify a contact person at DPW who could ensure the swift removal of abandoned vehicles.  Commissioner Breeden noted that Austin Hasker has been very helpful in this respect in the past, and she pledged to forward his fax number to Ms. Reichhardt.

After this discussion, Commissioner Procida left the meeting, so that a quorum was lost.

Police Report

Officer Felicia Hope reported an increase in residential break-ins (a.k.a. "home invasions"), noting that most often the thieves entered houses from the rear through an unlocked basement window or door.  Very few of the break-ins, she noted, were the result of forced entry.  Officer Hope also reported a continuing high number of thefts from autos in PSA 205 and 206. 

Officer Hope reported that officers were aware that the emergency legislation was now in effect to allow vehicles with a current RPP sticker to park overnight closer to intersections than normally permitted. She explained, however, that their remains some confusion about the intent and scope of the legislation.

The efficacy of the installation of additional speed limit signs on 42nd Street was discussed, with Officer Hope commenting that the signs might swerve as a helpful reminder to drivers, but that the lack of signs in no way limited MPD's ability to enforce the speed limit.  Commissioner Ritzenberg then asked if MPD could assist her in getting from DPW a new "42nd Street" sign at the intersection of that street with Tunlaw Road and New Mexico Avenue.

Officer Hope reported on the MPD's continuing focus on "reciprocity" in PSA 205.  Commissioner Breeden thanked MPD for that focus, but also reported that Lt. Brian Bray had experienced difficulty securing cooperation from DPW in towing and booting the vehicles to which his officers had issued citations for "failure to secure D.C.tags/reciprocity permit," and that Lt. Eaves of PSA 201 had reported to her that the Board of Adjudication had been dismissing on a procedural ambiguity some of the tickets his officers had issued, and that the Board was dismissing the tickets if the issuing officer did not appear at the hearing, though the ticketing officer's presence is never required in the case of parking tickets, since officers would then never be on the street.  Commissioner Breeden noted that the procedural question had been overcome once two or three years ago by agreement between then 2nd District Commander Shannon Cockett and then Acting DMV Director Henry Lightfoot, and that the ANC would again press for written clarification.

New Business

ANC Printer

A motion was made, seconded, and carried unanimously to approve the following resolution:

RESOLVED, that ANC3B designates current Chair Monica Mizerek as custodian of the printer to be provided by the Chief Technology Officer for use by the Commission, and that as such, Commissioner Mizerek is responsible for the safe-guarding and appropriate use of the printer, which will remain property of the Government of the District of Columbia.

The Commission also expressed its gratitude to Councilmember David Catania and the Chief Technology Officer for their continuing assistance.

There being no further business, the meeting was adjourned at 8:30 p.m.
