Thursday, December 14, 2000

A regular, monthly, public meeting of ANC3B was called to order at 7:30 p.m. on Thursday, December 14, 2000 at Guy Mason Recreation Center. Commissioners present and constituting a quorum were: Monica Mizerek (02), Chair, who joined the meeting late; Ann Lloyd Breeden (03); Toni A. Ritzenberg (04); and James C. Lively (05). The seat vacated by Comissioner Procida (01) on November 21, remained vacant.

Police Report

MPD Sgt. James Brown gave a crime report for the preceding month, noting a continuing problem with thefts from autos and stolen autos. In the calendar year to date, crime in PSA 205 was down 7.23% from the same time in 1999, with crime in the city down 4%.

Residents of the 4114 Davis Place condominium asked Sgt. Brown to relay to Lt. Brian Bray copies of two tickets issued for expired tags in the parking lot of the condominium. Lt. Bray had informed a member of the condominium’s board and Commissioner Breeden that officers may not venture on to private property to issues tickets, with the exception of vehicles parked illegally in fire lanes or in handicapped spaces, without the permission/invitation of the property manager. As no permission had been granted in this case, Commissioner Breeden asked that the $100 tickets be rescinded if, in fact, the issuing officer was not within his authority in issuing the tickets.

Commissioner Lively asked that the Commission receive copies of any city service request forms that MPD files with city agencies, so that the ANC can monitor the city’s response and intervene as necessary to ensure that Public Works issues identified by the police are resolved.

Commissioner Breeden asked Sgt. Brown if he could determine if MPD had in fact requested the no parking signs installed at the intersection of Edmunds and 42nd Street in November, as reported by Karen Benefield at DPW. She also requested that, if MPD had requested the signs, it reconsider the request, or at least consider allowing overnight parking at the intersection, as nine badly-needed spaces were lost when the no-parking zone was created.

Approval of Minutes

The minutes of the November 9, 2000 meeting were approved as printed and distributed. (4-0-0)

November Expense Report

The expense report for November 2000 was approved as printed and distributed. (4-0-0)

New Business

DC General

As no one was present to represent the ANC coalition which had sought ANC3B’s support of their proposal relating to the future of DC General Hospital, no discussion of this matter occurred.

U.S. Parole Commission Release of Convicts

Comissioner Breeden raised the issue of the parole board’s releasing convicts accused of parole violations without conducting hearings, as reported in the December 8 edition of the Washington Post, and asked Commissioner Lively to consider holding a discussion of the issue with MPD and U.S. Attorney personnel at an upcoming meeting of the 2nd District Citizens Advisory Council, of which he is president.

FY 2001 Budget for ANC3B

The Treasurer recommended that the FY01 budget be based upon the actual expenditures for FY00, but the Commission did not vote on this proposal. On a related issue, on the recommendation of Comissioner Ritzenberg, the Commission agreed to continue to employ Christopher Lively as its administrator for FY01. (3-0-1)

Old Business

Tree Work

A brief report was given on the Department of Public Works’ progress in removing dead trees and planting new trees. It was noted that DPW had planted more trees than the ANC requested in its March 1999 plea for attention to the neighborhood’s trees.

ABC Legislation

Milt Grossman pledged to prepare for the Commission a draft letter to City Council stating ANC3B’s position on the ABC legislation before Council and scheduled for a final vote on December 19.

Report of the District of Columbia Auditor

The Commission discussed the findings of the Auditor and preparations for the Commission’s response.

Adjournment

There being no further business, the meeting adjourned at 8:30 p.m.
